Opinions of the CPC Central Committee and The State Council on Promoting the Development and Growth of the Private Economy

The private economy is a new force for promoting Chinese-style modernization, an important foundation for high-quality development, and an important force for building China into a great modern socialist country in all respects and achieving the second centenary Goal。In order to promote the development and growth of the private economy, the following opinions are put forward。
I. General requirements
Guided by Xi Jinping Thought on Socialism with Chinese Characteristics for a New Era，We will thoroughly implement the guiding principles of the Party's 20 National Congresses，Adhere to the general principle of seeking progress while maintaining stability，Implement the new development concept in a complete, accurate and comprehensive manner，We will accelerate the building of a new pattern of development，We will strive to promote high-quality development，Adhere to the direction of socialist market economy reform，Adhere to the "two unwavering"，We will accelerate the creation of a market-oriented, law-based and internationalized business environment，We will improve the environment for the development of the private economy，We will protect the property rights of private enterprises and the rights and interests of entrepreneurs，We will comprehensively build friendly and clean relations between government and business，Economic entities under all forms of ownership shall have equal access to factors of production, participate in fair market competition, and enjoy equal legal protection，We will guide private enterprises to continuously improve the quality of development through their own reform and development, compliance management, transformation and upgrading，We will encourage the private sector to grow bigger, better and stronger，We will make positive contributions to the new journey of comprehensively building a modern socialist country，It has shouldered greater missions, shouldered heavier responsibilities and played a greater role in the historical process of the great rejuvenation of the Chinese nation。
Second, we will continue to improve the environment for the development of the private economy
We will build a high-level socialist market economic system, continuously optimize a stable, fair, transparent and predictable development environment, and fully stimulate the vitality of the private economy。
1. Continuing to remove market access barriers。No region or department shall set up access barriers in the form of filing, registration, annual inspection, identification, certification, designation, and requiring the establishment of branch offices or in disguised form。We will clean up and standardize the preconditions and approval standards for administrative examination and approval, licensing, filing and other government services, and shall not convert government services into intermediary services, and shall not require enterprises to conduct self-testing, inspection, certification, appraisal, notarization, or provide certificates before providing government services without legal and regulatory basis。We will steadily assess the effectiveness of market access, establish a complaint and response mechanism for market access barriers, and improve the system for collecting and reporting typical cases。
2. Fully implementing the fair competition policy system。We will strengthen the fundamental position of competition policy, improve the institutional framework and policy implementation mechanism for fair competition, and treat enterprises of all types of ownership on an equal footing。Strengthen anti-monopoly law enforcement to stop the abuse of administrative power to exclude and restrict competition。Without fair competition, operators shall not be granted franchise rights, and they shall not restrict the operation, purchase and use of goods and services provided by specific operators。We will regularly introduce a negative list of market interventions, and promptly review and repeal policies that impede the unified market and fair competition, including local protection, market segmentation, and designated transactions。We will optimize and improve the implementation of industrial policies, establish a catalogue and list of enterprise-related preferential policies, and make them available to the public in a timely manner。
3. Improving incentive and restraint mechanisms for social credit。Improve the credit information recording and sharing system, comprehensively promote the credit commitment system, and incorporate commitment and performance information into credit records。Give play to the role of credit incentive mechanism and enhance the sense of gain of enterprises with good credit。We will improve the credit restraint mechanism and punish responsible entities according to the list of disciplinary measures for dishonesty in accordance with the law and regulations。Improve the credit repair mechanism after the correction of dishonest behavior, and study and introduce relevant management measures。We will improve the government's credit performance mechanism, establish a sound record and disciplinary system for government dishonesty, and include information on government agencies and public institutions that break contracts, default on accounts, and refuse to perform judicial judgments into the national credit information sharing platform。
4. Improving market-based restructuring mechanisms。Encourage private enterprises to make good use of existing assets to recover funds。Adhere to the accurate identification and classification of policies, and actively apply bankruptcy reorganization and bankruptcy settlement procedures to enterprises that are in financial difficulties but still have development prospects and rescue value in accordance with the principles of marketization and rule of law。We will promote the revision of the enterprise Bankruptcy Law and improve supporting systems。We will optimize policies related to the conversion of individual industrial and commercial households to enterprises and reduce the cost of conversion。
Third, increase policy support for the private economy
We formulated and implemented various support policies in a precise manner, improved the way policies were implemented, strengthened policy coordination, responded promptly to concerns and interest demands, and effectively resolved practical difficulties。
5. Improving financing support policies and systems。We will improve the market-based mechanism for sharing financing risks involving banks, insurance companies, guarantees and securities firms。We will improve the credit rating and evaluation system for micro, small and medium-sized enterprises and individual industrial and commercial households, strengthen the collection of credit information related to enterprises, and promote service models such as "Xinyi Loan"。We will support qualified private micro, small and medium-sized enterprises to raise financing in the bond market, encourage qualified private enterprises to issue bonds of scientific and technological innovation companies, and expand the coverage of the special support plan for private enterprises' bond financing and enhance their creditworthiness。Support qualified private enterprises to go public for financing and refinancing。
(6) Improve the regular prevention and liquidation mechanism of arrears。We will strictly implement the Regulations on Safeguarding Payments for Small and Medium-sized Enterprises, improve the long-term mechanism for preventing and resolving delinquent accounts of small and medium-sized enterprises, and increase the accountability and punishment of those responsible in accordance with the law and regulations。Organs, public institutions and large enterprises shall not change their internal personnel, perform internal payment procedures, or refuse or delay payment to small and medium-sized enterprises and individual industrial and commercial households on the grounds of waiting for the approval of completion acceptance and final accounting audit without any agreement in the contract。Establish a system of regular disclosure, advice and guidance, and active law enforcement of arrears。Strengthen the disclosure of commercial draft information and improve the credit restraint mechanism of the bill market。Improve the complaint handling and credit supervision mechanism of delinquent accounts, and strengthen the exposure of malicious delinquent accounts。We will improve the normal docking mechanism between the settlement of delinquent accounts and the auditing, supervision and inspection systems。
7. Strengthening human resources and employment requirements。We will smooth the flow of talents to private enterprises, and improve the policy mechanisms for personnel management, file management, and social security。We will improve the methods for assessing professional titles of private enterprises, smooth the channels for assessing professional titles of private enterprises, and improve the standards for assessing professional titles based on market evaluation。Build a platform for connecting private enterprises, individual industrial and commercial businesses with employment information and job hunting information for workers。We will vigorously promote school-enterprise cooperation and the integration of industry and education。We will promote the construction of industrial workers in the private economy and optimize the environment for career development。We will strengthen protection of the rights and interests of workers in flexible employment and new forms of employment, and give play to the role of platform enterprises in expanding employment。
8. Improving the mechanism for providing direct access to support policies。We will give full play to the role of the direct access mechanism for financial funds, and promote the direct access of funds to enterprises。We will increase the disclosure of subsidy funds for enterprises and accept social supervision。For private micro, small and medium-sized enterprises and individual industrial and commercial enterprises to establish a support policy "free to enjoy" mechanism, promote the notification commitment system, the relevant departments can extract materials through the public data platform, no longer require repeated provision。
9. Strengthen policy communication and guidance on expectations。Implement the adjustment procedures of enterprise-related policies in accordance with the law and regulations, and set a reasonable transition period according to the actual situation。We will strengthen the issuance and interpretation of policies directed at private enterprises and individual industrial and commercial households。We will support government departments at all levels in inviting outstanding entrepreneurs to conduct consultations, and give full play to the role of entrepreneurs in the formulation and evaluation of enterprise-related policies, plans and standards。
Fourth, strengthen the legal guarantee for the development of the private economy
We will improve the legal environment for equal protection of all types of ownership, and create good and stable expectations for the development of the private economy。
(10) Protecting the property rights of private enterprises and the rights and interests of entrepreneurs。Prevent and correct the use of administrative or criminal means to intervene in economic disputes, as well as local protectionism in law enforcement and the administration of justice。We will further standardize mandatory property-related measures, and avoid seizing, seizing and freezing assets beyond the limits of authority, scope, amount, and time limit。For the commercial property involved in the case that is not suitable for sealing, seizing and freezing, while ensuring the normal conduct of investigation activities, the relevant parties may be allowed to continue to use it rationally, and necessary preservation measures may be taken to minimize the impact of investigation on normal office work and lawful production and operation。We will improve mechanisms for appeals and retrials of enterprise-related cases, and improve mechanisms for effective prevention and regular correction of wrongful cases。
(11) Establish a system and mechanism for preventing and controlling corruption at the source of private enterprises。A judicial interpretation has been issued to increase punishment for corruption involving staff members of private enterprises, such as embezzlement, embezzlement of funds, and bribery。Improve the recovery and disposal mechanism of property involved in the case。We will deepen the compliance reform of enterprises involved in the case and encourage private enterprises to operate in compliance with the law。Strengthen the governance of corruption sources in private enterprises, and guide private enterprises to establish a strict audit and supervision system and a financial and accounting system。Give full play to the role of party organizations in private enterprises, promote enterprises to strengthen rule of law education, and create an honest and clean corporate culture atmosphere。Establish a corruption governance mechanism for private enterprises with the participation of multiple entities。We will promote the development of private enterprises based on the rule of law and clean private enterprises。
12. Continue to improve the intellectual property protection system。We will intensify efforts to protect the original innovation of private micro, small and medium-sized enterprises。We will strictly implement the system of punitive damages for intellectual property infringement and act preservation。Establish a mechanism for rapid handling of intellectual property infringement and administrative non-litigation enforcement, and improve the cross-regional jurisdiction system of intellectual property courts。We will study and improve measures for the protection of intellectual property rights for business improvement, cultural creativity and other innovative achievements, and crack down on unfair competition acts such as infringement of trade secrets, counterfeiting and confusion, and illegal acts such as malicious trademark registration。We will intensify the criminal crackdown on violations of intellectual property rights。We will improve the guidance mechanism for dealing with overseas intellectual property disputes。
13. Improving the supervision and law enforcement system。We will strengthen regulatory standardization, make regulatory standards and rules public in accordance with the law, and make regulatory systems and policies more stable and predictable。Improve the fairness, standardization, and simplicity of supervision, and put an end to selective law enforcement and "self-proving" supervision of enterprises。Encourage cross-administrative regions to jointly issue unified regulatory policies, regulations and standards in accordance with regulations, and carry out joint law enforcement。In accordance with the principle of combining education and punishment, the implementation of law enforcement methods such as notification, reminder, and persuasion, and no administrative punishment shall be imposed on those who violate the law for the first time and have minor harmful consequences and correct them in time。
(14) Improve the long-term supervision mechanism for enterprise-related fees。We will continue to improve the list system of enterprise-related charges set by the government, publicize them regularly, and accept supervision from enterprises and society。Smooth the channels for enterprises to complain about illegal charges, establish a standardized problem clue department sharing and transfer mechanism, comprehensively adopt market supervision, industry supervision, credit supervision and other means to implement joint punishment, and publicly expose typical cases of illegal charges。
Fifth, we will strive to promote high-quality development of the private economy
Guide private enterprises to practice the new development concept, deeply grasp the existing shortcomings and challenges, change the mode of development, adjust the industrial structure, change the growth momentum, stick to the main business, strengthen the industry, and consciously take the road of high-quality development。
15. Guiding the improvement of governance structure and management system。We will support and guide private enterprises in improving their corporate governance structure, standardizing shareholder behavior, and strengthening internal supervision to achieve standardized governance, effective checks and balances, and compliant operations, and encourage qualified private enterprises to establish and improve a modern enterprise system with Chinese characteristics。Promote the separation of enterprise legal person property from investor's personal or family property in accordance with the law, and clarify the structure of enterprise property rights。Research on the establishment of risk assessment systems and warning mechanisms to give early warning of situations that seriously affect enterprise operations and may lead to social stability risks。Support private enterprises to strengthen risk prevention and management, guide the establishment of a comprehensive risk management system covering various fields such as enterprise strategy, planning, investment and financing, and market operation, and improve quality management awareness and capabilities。
(16) Supporting efforts to enhance scientific and technological innovation capabilities。Private enterprises are encouraged to continue to increase investment in research and development in accordance with national strategic needs and industry development trends, carry out key core technology research, and actively undertake major national science and technology projects in accordance with regulations。Cultivate a number of private technology leaders in key industries, specialized and new small and medium-sized enterprises, and small and medium-sized enterprises with strong innovation ability。Increase government procurement of innovative products, give full play to the role of the first (set) insurance compensation mechanism, and support the iterative application of innovative products by private enterprises。We will promote integrated innovation among enterprises of different ownerships and among large, small, and medium-sized enterprises, and carry out joint research on common technologies。We will improve the management system and achievement transformation mechanism of institutions of higher learning and research institutes, mobilize their enthusiasm to support the innovation and development of private micro, small and medium-sized enterprises, and support private enterprises to cooperate with scientific research institutions to establish innovation platforms such as technology research and development centers, industrial research institutes, pilot maturation bases, engineering research centers, and manufacturing innovation centers。We will support private enterprises in strengthening basic cutting-edge research and translating results。
17. Accelerating digital transformation and technological transformation。Private enterprises are encouraged to carry out research and development of digital generic technologies, and participate in the investment and application innovation of new infrastructure such as data centers and industrial Internet。Support the digital transformation of small and medium-sized enterprises, and promote the popularization and application of low-cost, modular intelligent manufacturing equipment and systems。Guide private enterprises to actively promote standardization construction and improve product quality。Support private enterprises to step up green and low-carbon transformation of production processes, equipment and technologies, accelerate the development of flexible manufacturing, improve emergency capacity expansion and transformation, and enhance the resilience of the industrial chain。
18. Encourage greater international competitiveness。Support private enterprises based on their own reality, and actively extend to the core parts and high-end manufactured products design and research and development direction;Strengthen brand building and enhance the reputation of "Made in China"。Private enterprises are encouraged to expand overseas business, actively participate in the joint construction of the "Belt and Road", participate in overseas projects in an orderly manner, and comply with local laws and regulations and fulfill social responsibilities in going global。Better guidance and support for private enterprises to guard against and respond to external challenges such as trade protectionism, unilateralism and "long-arm jurisdiction"。Strengthen departmental coordination and cooperation, and establish a cooperation mechanism to prevent and defuse risks for the personal and property safety of private businessmen overseas。
19. Supporting participation in major national strategies。Private enterprises are encouraged to expand employment and improve the wage distribution system voluntarily to improve the level of employees enjoying the fruits of enterprise development。We will support private enterprises in investing in labor-intensive manufacturing, equipment manufacturing, and ecological industries in the central and western regions and Northeast China, accelerate the development of old revolutionary base areas and ethnic minority areas, and invest in border areas to revitalize border areas and enrich the people。Support private enterprises to participate in promoting carbon peak carbon neutrality, provide carbon reduction technologies and services, increase investment in renewable energy power generation and energy storage, and participate in carbon emission rights and energy use rights trading。We will support the participation of private enterprises in rural revitalization, encourage new agricultural business entities and social service organizations to develop modern farming and breeding industries, develop high-quality modern agricultural product processing industries, develop modern agricultural service industries in light of local conditions, expand leisure agriculture, rural tourism and other characteristic industries, and actively participate in the "ten thousand enterprises revitalizing ten thousand villages" action。We will support private enterprises in comprehensively strengthening infrastructure development, and guide private capital to participate in major projects such as new urbanization, transportation and water conservancy, and in areas that strengthen weak spots。
20. Regulating and guiding the healthy development of private capital in accordance with the law。Improve the legal system to regulate and guide the healthy development of private capital, set up "traffic lights" for capital, improve the rules of the capital behavior system, and centrally introduce a number of "green light" investment cases。We will comprehensively improve the efficiency of capital governance, improve the capacity of capital supervision and the modernization of the supervision system。Guide the platform economy to develop in the direction of opening up, innovation and empowerment, make up for the weak areas of development, support the platform enterprises to play a big role in creating jobs, expanding consumption and international competition, and promote the standardized, healthy and sustainable development of the platform economy。Encourage private enterprises to focus on strengthening their main business and improving their core competitiveness。
6. Promoting the healthy growth of private businessmen
Comprehensively implement the principles of trust, unity, service, guidance and education, stabilize people's hearts with practical measures, inspire people and gather people's hearts, and guide private businessmen to carry forward the entrepreneurial spirit。
(21) Improve the ideological and political construction mechanism for private businessmen。Actively yet prudently do a good job in developing party members among advanced members of representatives of the private economy。We will deepen education on ideals and beliefs and core socialist values。Educate and guide Party members in private economic circles to firmly uphold their ideals and convictions, play a vanguard and exemplary role, and resolutely implement the Party's theories, lines, principles and policies。Actively explore and innovate the working methods of party building in the private economy。
(22) Fostering and promoting entrepreneurship。Guide private entrepreneurs to strengthen patriotic feelings, courage to innovate, integrity and law-abiding, assume social responsibilities, expand international horizons, dare to venture and work, and constantly stimulate innovation vitality and creative potential。We will give full play to the exemplary role of outstanding entrepreneurs, increase selection and commendation efforts in accordance with regulations, vigorously cultivate entrepreneurship in the private economy, and promptly summarize and promote the growth experience of entrepreneurs with Chinese characteristics and in line with the trend of The Times。
(23) Strengthening the construction of representatives of the private economy。We will optimize the structure of the ranks of representatives of the private economy, improve the selection mechanism, take into account enterprises of different regions, industries and sizes, and give proper preference to strategic emerging industries, high-tech industries, advanced manufacturing, modern service industries, and modern agriculture。We will standardize political arrangements, improve the relevant comprehensive evaluation system, properly recommend outstanding private businessmen as candidates for deputies to people's congresses at all levels and candidates for CPPCC members, and give full play to the role of the Federation of Industry and Commerce as the main channel for orderly political participation of private businessmen。We will support representatives of the private sector in playing a greater role in international economic activities and organizations。
24. Improving the education and training system for private businessmen。We will improve special training and study and discussion mechanisms for private economists, and further strengthen education and training。We will improve the training system for private micro, small and medium-sized enterprises, and build a multi-disciplinary and multi-level training system that combines online and offline services。Strengthen the echelon training of private economic personnel, establish and improve the system of guidance and guidance for the younger generation of private economic personnel, and promote the handover and orderly inheritance of undertakings between the old and the new。
25. Comprehensively building pro-clean relations between government and business。To implement the construction of pro-Qing government and business relations, party and government cadres and private entrepreneurs should establish a new type of pro-Qing and unified government and business relations in both directions。Leading cadres at all levels should be candid and sincere in contact with private entrepreneurs, take the initiative to act and serve at the forefront, solve problems for private enterprises and private entrepreneurs in accordance with the law and regulations, do practical things, hold the bottom line of exchanges, prevent risks of clean government, and be friendly and moderate, clear and promising。Private entrepreneurs should take the initiative to communicate with party committees and governments at all levels and departments, tell the truth, tell the truth, build forthe truth, keep clean and take the right path, abide by the law and discipline to run enterprises, and engage in above-board management。
7. Continue to create a social atmosphere that cares about promoting the development and growth of the private economy
Guide and support the private economy to fulfill its social responsibilities, show a good image, better interact with public opinion, and create a good social atmosphere with correct understanding, full respect, and active concern for the private economy。
(26) Guide the whole society to have an objective, correct and comprehensive understanding of the private economy and private economic personnel。Strengthen theoretical research and publicity, adhere to the principle of seeking truth from facts, objectivity and justice, grasp the correct direction of public opinion, guide the society to correctly understand the major contribution and important role of the private economy, and correctly view the wealth obtained by private economic personnel through legal and compliance operations。Resolutely resist, promptly refute and clarify erroneous remarks and practices that question the basic socialist economic system and deny or weaken the private economy, and promptly respond to concerns and dispel concerns。
(27) Fostering a public opinion environment that respects the innovation and entrepreneurship of the private economy。Strengthen the publicity and reporting of the advanced deeds of outstanding entrepreneurs, accelerate the construction of world-class enterprises, gather the positive energy of advocating innovation and entrepreneurship, and enhance the sense of honor and social value of entrepreneurs。Create a public opinion environment and the atmosphere of The Times that encourage innovation and tolerate failure, and give understanding, tolerance and help to the mistakes and failures of private economic personnel in the legal operation。Establish a departmental cooperation mechanism, strictly crack down on blackmail and other acts with negative public opinion as a threat in accordance with the law, improve the relevant reporting mechanism, and reduce the cost of enterprise rights protection。
(28) Supporting private enterprises to better fulfill their social responsibilities。Educate and guide private enterprises to consciously shoulder the social responsibility of promoting common prosperity, actively build harmonious labor relations within enterprises, and promote the construction of a community of interests for all employees, so that the development results of enterprises can benefit all employees more fairly。Encourage and guide private economic personnel to be doers of development and devotees of the new era, realize their personal value at a higher level, show the whole society a good image of abiding by the law and social morality, and be rich and responsible, rich and righteous, rich and loving。Explore the establishment of a social responsibility evaluation system and incentive mechanism for private enterprises, guide private enterprises to actively participate in glorious cause and public welfare charity, participate in emergency disaster relief, and support national defense construction。
8. Strengthen organization and implementation

Upholding and strengthening Party leadership。Adhere to the centralized and unified leadership of the Party Central Committee over the work of the private economy, and implement the Party's leadership in all aspects of the whole process of work。Adhere to the correct political direction, establish and improve the working mechanism for the development of the private economy and private enterprises, clarify and consolidate departmental responsibilities, strengthen coordination and cooperation, and strengthen the linkage between the central and local governments。We will support the Federation of Industry and Commerce in playing a better role in promoting the healthy development of the private economy and the healthy growth of private businessmen。
30. Improving incentive and restraint mechanisms。We will strengthen the supervision and implementation of existing policies, focus on promoting the development and growth of the private economy, protecting property rights, promoting entrepreneurship and other policies, and improve the evaluation and supervision system。We will establish and improve a platform for protecting the rights of private economic complaints, and improve the confidentiality system, handling procedures and supervision and assessment mechanism for complaints and reports。
(31) Make timely summary and evaluation。Special evaluation and review of private economic policies are carried out in the evaluation of consistency with macro policy orientation。We will improve the evaluation system for China's business environment and the third-party evaluation mechanism for the effectiveness of policy implementation。Strengthen the statistical monitoring and evaluation of the private economy, and study and compile a unified and standardized private economy development index when necessary。Continue to innovate and develop the "Jinjiang experience", summarize and promote the good experience and good practices around the country in a timely manner, and consolidate the effective experience and practice in an appropriate form。
